Terms of Service

Aptitude Technology, LLC

Welcome to Aptitude Technology, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our services, including cybersecurity, IT Help Desk (remote), cloud computing, and any related websites, platforms, or communication channels (collectively, the "Services"). Our principal place of business is located at 8605 Santa Monica Blvd PMB 331698, West Hollywood, CA 90069. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, becoming a client, or otherwise using our Services, you acknowledge that you have read, understood, and agree to these Terms, along with our Privacy Policy (incorporated by reference). These Terms apply to all users, including individuals and entities.


2. Description of Services

Aptitude Technology, LLC provides a comprehensive suite of technology solutions tailored to meet the needs of both commercial and residential clients. Our Services are designed to enhance operational efficiency, security, and connectivity through innovative and customized offerings, including but not limited to:


  • Cybersecurity: Advanced monitoring, threat detection, and mitigation strategies to safeguard your systems, networks, and sensitive data from cyber threats.
  • IT Help Desk (Remote): Prompt and reliable remote technical support and troubleshooting to address your IT challenges, ensuring minimal downtime.
  • Cloud Computing: Secure hosting, management, and optimization of your data and applications in scalable cloud environments, tailored to your business requirements.
  • On-Site Workstation Assistance: Hands-on support for workstation setup, configuration, maintenance, and troubleshooting at your location to ensure seamless operations.
  • Custom Networking Solutions: Design and implementation of bespoke networking infrastructure, optimized for your specific business type, to ensure robust connectivity and performance.
  • Security Systems: Installation and maintenance of state-of-the-art security cameras and smart entry systems (doors and gates) to enhance physical and digital security.
  • Website and App Development: Custom-designed websites and mobile applications crafted to align with your brand and business objectives, delivering exceptional user experiences.
  • Structured Cabling and Rewiring: Professional installation and rewiring services using Cat6/7, coaxial, AV cables, and other specialized cabling for network switches, AV equipment, access points, network-attached storage (NAS), and other devices, ensuring reliable and high-speed connectivity.
  • VoIP Phone Systems: Setup, configuration, and ongoing maintenance of Voice over Internet Protocol (VoIP) phone systems, providing cost-effective and feature-rich communication solutions.
  • Consulting and Integration Services: Expert guidance on technology strategy, system integration, and digital transformation to align IT infrastructure with your long-term goals.

Our Services are available for both commercial and residential clients, and we pride ourselves on delivering personalized solutions that drive productivity, security, and innovation. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.


3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use our Services. By using the Services, you represent that you meet these requirements.


4. Account Registration and Responsibilities


a. Account Creation

To access certain Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated.

b. Account Security

You are responsible for maintaining the confidentiality of your account credentials (e.g., username and password) and for all activities under your account. Notify us immediately at privacy@aptitude-technology.com if you suspect unauthorized use.


5. Fees and Payment


a. Pricing

Certain Services (e.g., cloud computing subscriptions, cybersecurity packages, or IT Help Desk support plans) may require payment. Fees will be outlined in your Service Agreement or at the point of purchase. Specific terms, including pricing and payment schedules, may vary based on your individual Service Agreement.

b. Payment Terms

All invoices are due upon receipt unless otherwise stated in a separate agreement. If an invoice remains unpaid 7 days after issuance, a late fee of 2.5% of the total invoice amount may be applied. If an invoice remains unpaid after 14 days, an additional late fee of 3.5% of the total invoice amount may be applied. For invoices unpaid beyond 14 days, we reserve the right to apply interest at 1.5% per month on the outstanding balance and may suspend Services until the account is paid in full.

c. Non-Readiness Fees

If you are not prepared for scheduled Services, non-readiness fees may apply, including:

  • IT Help Desk (Remote): $25 fee if you are not ready for remote assistance at the scheduled time.
  • Cybersecurity Consultation: $50 fee if you lack necessary materials or access for the scheduled engagement.
  • On-Site Workstation Assistance: Full invoiced amount if you fail to provide necessary materials (e.g., workstations, employees) or access at the scheduled time.

d. General Payment Obligations

You agree to pay all applicable fees in a timely manner. Payments are non-refundable except as specified in a separate agreement or required by law.

e. Changes to Fees

We may adjust fees with reasonable notice, typically 30 days, as specified in your Service Agreement. Continued use of the Services after such changes constitutes acceptance of the new fees.


6. Text Messaging Program

We offer optional text messaging for updates, alerts, or support notifications.

a. Offering

You may opt in to receive SMS messages from us at (844-456-4256) by creating an account or becoming a client.

b. Opt-Out

To stop receiving messages, reply STOP to any text from (844-456-4256). You may receive a final confirmation message after opting out.

c. Costs

Standard message and data rates may apply. We are not responsible for any charges incurred.


7. Acceptable Use

You agree to use our Services only for lawful purposes and in compliance with these Terms. You may not:


  • Use the Services to harm, disrupt, or interfere with our systems, networks, or other users.
  • Attempt to gain unauthorized access to our cybersecurity tools, cloud platforms, or IT Help Desk systems.
  • Upload, store, or transmit malicious code, viruses, or harmful content via our Services.
  • Violate any applicable laws or regulations.

We reserve the right to suspend or terminate your access if you violate these Terms.


8. Intellectual Property


a. Our Rights

All content, software, and materials provided as part of the Services (e.g., cybersecurity tools, cloud interfaces, or support documentation) are owned by Aptitude Technology or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute them without our written permission.

b. Your Content

You retain ownership of any data or content you upload to our cloud computing Services or share with our IT Help Desk. By providing such content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it as necessary to deliver the Services.


9. Limitation of Liability


To the fullest extent permitted by law, Aptitude Technology, its affiliates, and employees will not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the Services.
  • Loss of data, profits, or business opportunities, even if advised of such possibilities.
  • Service interruptions due to factors beyond our control (e.g., internet outages, third-party breaches).

Our total liability shall not exceed the amount you paid us for the Services in the prior 12 months.


10. Disclaimer of Warranties


Our Services are provided "as is" and "as available." We do not warrant that:

  • The Services will be uninterrupted, error-free, or completely secure.
  • Cybersecurity measures will prevent all threats or breaches.
  • IT Help Desk support will resolve all issues.

We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the extent permitted by law.


11. Termination


a. By You

You may stop using the Services at any time and request account deletion by contacting us at privacy@aptitude-technology.com.

b. By Us

We may suspend or terminate your access to the Services if you breach these Terms, fail to pay fees, or for any other reason at our discretion, with or without notice.

c. Effect of Termination

Upon termination, your right to use the Services ceases. We may retain certain data (e.g., cybersecurity logs) as required by law or our policies.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You agree to submit to the jurisdiction of these courts.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with the "Last Updated" date revised. Continued use of the Services after changes constitutes acceptance of the new Terms.
